What rights do i have against charges for late payments due to post.?

I posted payment or an item at least 3 days before it was due, the finance company now say they didnt get the payment untill 8 days after it was due and now want over 锟?00 in late payment costs from me. What rights do i have against this company as i feel it is completely unfair as i sent the payment. The total amount due was only 锟?28. They did not send any information stating that the payment was late as I could have tried to do something about it before the chargs reached a stupid amount.

If the payment you sent was a cheque or money order or postal order, then it would have taken a couple of days to clear out of your bank account and then a few more days to show on the finance company's account. This is not the finance company's fault and, unfortunately, you are responsible for any charges this incurred.

File a protest against the charges for late payment and prove that you paid before the due date.

Check the small print, they may have something written that say please allow 4 days for postage and 4 for cheques to clear. In which case your stuffed.



If it says less days than this, then you may have case to fight against them. There was something out a few months ago, where some finance ombudsman said the banks etc. could no longer charge huge amount for missed payment, overdrawn etc.. That might apply to their excessive charges too.
You have no rights in this case, it is your responsibility to mail your payment at least ten days prior to the due date. Read the contract you signed.
I would write a letter stating exactly what you have said here, keep a copy and wait for a reply. If it is the first time a payment has been made late they may be willing to accept your reasons on this occasion. State that you are a good customer and that you have always made payment on time in the past and that the payment reached them late on this occasion due to errors in the postal process and not due to your negligence. I cannot see how they can charge this sort of amount for a payment which is late by 8 days it's ridiculous. Contact your local CAB to find out where you stand legally but stay calm and polite when in contact with the company, if you get angry and rude they are less likely to do anything in your favour, also ask them to stop adding charges whilst this dispute is in process. Trade Standards, Citizens advice bureau, try them. I think they do it on purpose actually. You need to put it writing and then perhaps take it further after their response to your letter. Did you send a cheque then. The date on the cheque will help as well as your date on the letter. They do normally warn you about sending postal papers.
get tuff a simple quick note, "Yer gettin, nowt.
It is going to come down to when you received the bill. If you had ample time to send the payment in then you have no one to blame but you.



Companies don't go by the post date they go by when the money is posted to the account.



You can argue and fight all you want and I wish you luck on this, it would be nice to see someone win for a change. Let us know please!
All such charges must be fair and realistic and you must have been made aware of them PRIOR to forming the contract. Where finance company late payment fees are concerned, there is presently a movement against such charges as they are illegal under UK consumer credit law.



Realistic charges are not 锟?00 for a 锟?28 debt. Pay the debt, but not the extra charges. Take this to your local Citizens Advice Bureau, they will point you in the right direction.
Well, three days before the due date doesn't seem early enough, to be honest. Using regular mail, there's no telling how long it will get there.



On the day you sent the payment, did you call the company to let them know that you mailed it? That's why I do if I think the payment might not get there in time -- in such cases, they'll probably cut you a break on the late charges if they know ahead of time that payment is coming.
send them a letter where you refuse to pay the charges and at the same time let them know you can stand any publicity better than they if it gets into the small claims court. Do they want their name connected with sharp trading?
